New Mandatory Bail Conditions: Weapons Bans, Curfews and Area Restrictions

October 1, 2026 · Steven D. Norton

Release conditions are meant to manage the specific risks the court identifies. Since July 15, 2026, the Criminal Code directs courts toward certain conditions for certain charges.

Weapons prohibitions

For specified offences — including extortion and organized crime — courts must generally impose a weapons prohibition unless it is not needed for public or victim safety.

Charge-specific conditions

  • Extortion and organized crime: courts must consider no-contact orders with victims or witnesses and geographic limits.
  • Auto theft and home break-ins: courts must consider geographic limits, curfews, and a ban on possessing break-in tools.

Keeping conditions workable

Conditions still need to be reasonable and connected to real risk. Overly broad conditions set people up to fail and lead to breach charges. A good bail plan proposes conditions the person can actually follow — around work, school, family and medical needs — while still satisfying the court.
